PERSONAL INJURY FAQs

Do I have a claim?

Successful personal injury claims generally require the presence of three things, among others: (1) liability; (2) damages, which may include past and future medical bills, lost wages, and present and future pain and suffering due to your physical or mental condition; and (3) a source of payment from whom you can collect your damages. If these three elements are present in your case, you may likely have a case for an attorney to pursue.

What is a contingency fee?

Bober & Bober, P.A. handles most cases, including personal injury cases, on a contingency fee basis. This means that if Bober & Bober, P.A. cannot recover any money for your claim, then you will not owe any attorneys’ fees. If Bober & Bober, P.A. does recover money for your claim, then the fee you pay usually will be a percentage of the total amount of the money we obtain on your behalf.

How long will my case take to be resolved?

Bober & Bober, P.A. will work to promptly and successfully resolve your case. In cases involving personal injury, however, it may be in your best interest not to resolve your case until your medical treatment and recovery period have been completed or reached a stage where your injuries have stabilized. During the treatment and recovery phase, we will monitor your medical treatment and gather treatment information. Depending on the extent of your injuries, the treatment may take a few months or more than a year. Depending on your injuries, we will work with you to determine how best to pursue your case within the legal system.

Will my case settle without going to court?

Most personal injury cases settle without the necessity of going to trial. At Bober & Bober, P.A., however, we prepare each case as if it will ultimately go to trial so that our clients can litigate from a position of strength. Preparation includes presenting the facts of your case in the light most favorable to you and having access to experts and physicians who can properly evaluate your injuries or claims where necessary.

How much is my claim worth?

Many factors determine the value of a claim. For example, in auto accident cases, factors such as your age, your earning history, the seriousness of the injury, and the degree of the other person’s negligence are some of the factors considered in determining fair compensation. At Bober & Bober, P.A., we will discuss all the relevant factors with you throughout the progression of your case. Our only goal, however, is to help you achieve the maximum recovery possible under the facts of your particular claim.
